Terms of Service

These Terms of Service (“Terms”) govern your use of atey20 at atey20.com (the “Service”). By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of an organization you confirm that you have authority to bind that organization to these Terms.

1. The Service & disclaimers

atey20 helps people discover healthier restaurant options, review nutrition insights, and collaborate on community submissions. The Service may surface estimated nutrition data derived from user-submitted photos or third-party sources. We do not provide medical, nutritional, or dietary advice. Always consult a qualified professional before making health, medical, or dietary decisions.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 you must have permission from a parent or guardian.

3. Accounts & communications

Some features require an account or verified email address. You agree to provide accurate information and keep it up to date. We may send you transactional emails (such as receipts, moderation updates, or security alerts). You can opt out of marketing emails at any time.

4. Subscriptions, payments, and refunds

Paid features (for example Day Pass or Pro subscriptions) are processed by Stripe. Pricing, trial periods, and renewal terms are shown at checkout. Subscriptions automatically renew until canceled in the Stripe Customer Portal. Refund requests must comply with our posted refund policy or will be handled at our discretion.

5. User content

“User Content” includes photos, dish submissions, UGC uploads (“Foodie Flicks”), restaurant data, comments, labels, or other materials you provide. You retain ownership of your User Content, but by submitting it you grant atey20 a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free license to host, store, reproduce, modify, adapt, translate, distribute, publish, publicly display, publicly perform, and create derivative works from your User Content in connection with operating, improving, and promoting the Service. This includes featuring submissions on the site, social channels, emails, and future products.

You represent and warrant that you have all rights necessary to grant this license and that your User Content does not infringe or violate any third-party rights or applicable law. Do not submit content that is unlawful, defamatory, discriminatory, fraudulent, sexually explicit, harassing, unsafe, or misleading. We may moderate, edit, or remove User Content at our sole discretion. Additional rules appear in our UGC Guidelines.

6. Acceptable use

  • Do not scrape, crawl, or harvest content beyond what is necessary for normal use.
  • Do not reverse engineer, interfere with, or attempt to bypass security measures or rate limits.
  • Do not impersonate others or misrepresent your affiliation with a venue.
  • Do not submit malicious code, spam, or conduct that disrupts the Service.
  • Respect community members and follow the UGC Guidelines for all submissions.

7. Feedback

If you send ideas or suggestions, you grant us a license to use them without restriction or compensation. Feedback is optional and not confidential.

8. Third-party services

The Service relies on third parties such as Google Maps/Places, Supabase, Resend/Mailchimp, Stripe, and OpenAI. Their terms may apply when you use features powered by them. We are not responsible for third-party sites or services.

9. Intellectual property & DMCA

The Service, including all software, content, and branding, is owned by atey20 or our licensors. You may not copy, modify, or distribute our content without permission. If you believe content on the Service infringes your copyright, send a DMCA notice to support@atey20.com with: (a) your contact information, (b) identification of the work you believe is infringed, (c) the location of the allegedly infringing content, (d) a statement that you have a good-faith belief the use is not authorized, (e) a statement under penalty of perjury that the notice is accurate, and (f) your physical or electronic signature. We may disable or remove content in response to valid notices.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. NUTRITION ESTIMATES MAY BE INCOMPLETE OR INACCURATE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATEY20 AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

12. Indemnification

You agree to defend, indemnify, and hold harmless atey20 and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or connected with your use of the Service, your User Content, or your violation of these Terms or applicable law.

13. Governing law & venue

These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Maryland, and you consent to their jurisdiction.

14. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms or the UGC Guidelines. You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination (including licenses, disclaimers, limitations of liability, indemnity, and governing law) will survive.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will update the date above and, when appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
